TRANSFERENCIA ??

Por alguna razón que la mente oculta, al leer las noticias sobre la reunión Kirchner-Bush apareció el recuerdo del hecho histórico que dió lugar a lo que en derecho internacional hoy se conoce como Doctrina Drago. Sin preocuparme por descifrar que produjo la chispa en la memoria paso al relato, simplemente.

En 1902, Gran Bretaña, Alemania e Italia recurrieron a la intervención armada para recuperar, por la fuerza, la deuda que sus bancos tenían impaga en Venezuela. Mientras tanto, Estados Unidos se mantuvo prescindente, aunque no desalentó la acción bélica de las potencias europeas en el hemisferio.
El canciller argentino, Luis María Drago, seriamente preocupado por esa intervención, redactó una nota diplomática remitida al gobierno de Estados Unidos, afirmando que: la deuda pública de una nación latinoamericana no podía ser invocada para usar la fuerza contra un país; que la soberanía de una nación no podía ser violada para forzar el pago de una deuda. Con esta nota se configuraba una doctrina, esencial del derecho interamericano que contribuyó decisivamente a la formulación y aplicación del principio de no intervención.

Para conformar su teoria sienta ciertas premisas muy claras: 1) "que el capitalista que suministra su dinero a un Estado extranjero tiene siempre en cuenta cuáles son los recursos del país en que va a actuar y la mayor o menor probabilidad de que los compromisos contraídos se cumplan sin tropiezo";
2) "Todos los gobiernos gozan por ello de diferente crédito, según su grado de civilización y cultura y su conducta en los negocios, y estas circunstancias se miden y se pesan antes de contraer ningún empréstito, haciendo más o menos onerosas sus condiciones, con arreglo a los datos precisos que en ese sentido tienen perfectamente registrados los banqueros".
Y, 3) "...el acreedor sabe que contrata con una entidad soberana y es condición inherente de toda soberanía que no pueda iniciarse ni cumplirse procedimientos ejecutivos contra ella, ya que ese modo de cobro comprometería su existencia misma, haciendo desaparecer la independencia y la acción del respectivo gobierno"

Cierto es que ya no se cobra usando la fuerza bélica y la ocupación territorial; pero eso son solo expresiones de la presión, la injerencia, la interferencia....Drago escribía "ni con presión ejercida sobre los pueblos del continente por el solo hecho de una desdichada situación financiera que obliga a una de las partes a diferir el cumplimiento de sus obligaciones

En tiempos del Imperio suena ingenuo ¿no es así? Pero creo que valía la pena recordarlo.

Hoy, ante la infecunda parálisis de nuestra política exterior, conviene recordar ese momento histórico. Latinoamérica -la amplia Cuenca del Caribe, en particular- era objeto de reiteradas políticas de fuerza por parte de Europa y Estados Unidos. La vulnerabilidad externa de la región era tan notoria como la debilidad interna de los países del área. La constitución de las naciones era incipiente y la inserción al mercado mundial con productos primarios resultaba más embrionaria que consolidada.

Una Sudamérica fragmentada en países apenas viables estaba subordinada a los vaivenes de la realpolitik de la época. Inglaterra intentaba asegurar un orden imperial en el mundo y Estados Unidos pretendía garantizar su dominio hegemónico en su cercanía geográfica. El corolario casi obvio de una combinación de dependencia internacional, dispersión regional y fragilidad nacional era inhibir un despliegue externo vigoroso y solidario por parte de nuestros países.

Sin embargo, ése no fue el caso. Argentina, distante de los polos de poder y con ambición de proyección externa, recurrió con criterio y creatividad al derecho; ese insignificante recurso de los débiles según las visiones más extremas del realismo internacional y autóctono. Buenos Aires comprendió que la defensa de sus intereses nacionales estaba ligada a la salvaguardia de principios básicos para la convivencia entre las naciones.

La clase dirigente entendió que el unilateralismo periférico -la conducta internacional que se basa sólo en ventajas propias con la esperanza de obtener una concesión magnánima del poderoso- podía resultar atractivo en el corto plazo pero muy costoso en el largo plazo. Por eso la alarma frente al hecho de que la acción militar en Venezuela sentara un precedente funesto para la Argentina y toda la región.

El planteamiento de la Doctrina expresó también un nivel de solidaridad latinoamericana notable para un país que se presumía sólo miraba a Europa, en especial a Gran Bretaña, en términos de su política exterior.

El resultado de esta política argentina sustentada en una idea-fuerza concreta y coherente fue exitoso: no sólo evitó el cobro compulsivo de la deuda venezolana, sino que incrementó el prestigio y la influencia externas del país, al tiempo que la Doctrina Drago se convirtió en una pieza medular del derecho internacional.

Lo anterior obliga a una reflexión en términos de las fuentes de poder en la política mundial. Como bien lo indicó la que fuera una de las más lúcidas estudiosas de las relaciones internacionales contemporáneas, la británica Susan Strange, "el poder se deriva de tres fuentes: de la fuerza, de la riqueza y de las ideas".

En el caso de un país periférico y ante la ausencia de un poderío militar y/o material cuantioso, el papel de las "ideas"-en la doble significación de ideas como conocimiento e ideas como imaginación- resulta esencial. El saber y el conocimiento aplicados, junto con la imaginación y el despliegue de nuevas nociones y conceptos, se constituye en atributos de poder e influencia indispensables para elevar la gravitación de un país en el escenario mundial.

La Argentina de hace un siglo, aún frágil en su consolidación, con riquezas que apenas se comenzaban a movilizar pero con un proyecto de futuro, supo otorgarle a las ideas un lugar fundamental en su propia identidad y en su práctica internacional. La Doctrina Drago fue la expresión del rol que una clase dirigente capaz e innovadora le supo dar a las ideas.

Hoy, cuando el debate sobre el horizonte de nuestra política internacional es tan paupérrimo y estéril resulta fundamental evaluar con seriedad el lugar de las ideas; quizás el mayor recurso estratégico a nuestra disposición en las actuales circunstancias nacionales y mundiales.
