Una pregunta...
Me han ofrecido mi primer tema penal “serio”. “Serio” En tanto en cuanto que el fiscal, en el escrito de acusación pide una condena de cuatro años de cárcel. Y así entro por fin en un tema que hasta el momento y en el ejercicio profesional no había tenido que afrontar. Un bonito problema moral, que no es que me haya dejado en vela ni mucho menos; pero si que me pone en una tesitura que hasta ahora no me había planteado.
En un delito contra la seguridad colectiva.
Yo se que mi cliente es culpable. ¿Debo aceptar el caso e intentar conseguir una libre absolución? ¿Debo aceptar el caso e intentar conseguir una condena sueve atendiendo a las circunstancias existentes? ¿Debo rechazar el caso?
En definitiva...

Es tu trabajo como abogado defensor. Si solo quieres ayudar a los necesitados hazte de Medicos sin Fronteras, pero no puedes rechazar todos los casos en que tus defendidos sean culpables. Tarde o temprano lo tendrás que hacer, y creo yo que mejor temprano.
Aunque claro ¿qué ha hecho el energúmeno exáctamente?

En la Facultad no hacen más que repetirnos que del Derecho Penal comen pocos en este país, asín que, yo en tu lugar aceptaría el caso, e intentaría conseguir una libre absolución. ¿Pero por qué? Pues es sencillo: El tío es culpable, ¿no? Entonces que tu defensa no consiga nada tampoco es relevante. Si lo piensas bien, tú no vas a perder absolutamente nada. Así que intenta hacer "ingeniería jurídica" (como nos decía el tío Queralt en Financiero), y busca una absolución por algún sitio. Si ganas, podrás decir : "Vale, el tío era un cabrón, pero yo fuí más listo que el Fiscal. He conseguido lo impensable: absolver al culpable.". Y si pierdes siempre podrás decir "Es que, claro, si el tío era culpable, poco podía hacer yo por él, ¿no?" Y asunto resuelto... ¿o no....?
Supongo que lo que deberías hacer (sin ánimo de establecer dogma, desde luego), es lo que un profesional debe hacer, es decir: a ti te pagan (pagarían) por llevar el caso, así que se debe procurar conseguir la menor condena para el tipo, o la absolución si procede. Por la experiencia de compañeros, muchos casos de penal se sobreseen por chorradas de plazos o defectos de forma... Desde luego, un buen procurador es básico, (y un buen estómago si te vas a declinar por lo penal...)
Posted by: Moet on Mayo 10, 2004 07:21 PMYo nunca me dedicaría al penal, con el resto de ramas del derecho juegas, como mucho, con el dinero o interés económico de las personas; con el penal juegas, en muchos casos, con su integridad física y con uno de los derechos básicos: el de la libertad.
Aunque hay un adagio que dice que una persona olvida antes la muerte de un padre que la pérdida de todo su patrimonio.

Y como eres un buen profesional deberías intentar hacer todo lo posible para que le absuelvan, aunque es duro defender al malo de la pelicula.

No conozco un puto pijo de derecho, pero he visto muchas veces El Abogado y deberías convencerle de buscar una reducción de pena conforme a las circunstancias. Eso si pretendes dedicarte al derecho penal con unos resquicios de moralidad. Si lo de la moral te importa una mierda, entra a saco y déjalo libre. Si te importa demasiado, rechaza el caso o llama a Perry Mason.
